These Terms of Service ("Agreement") govern your use of the Flashteks platform and services provided by:

By accessing or using Flashteks software, websites, or services (collectively, the "Services"), you agree to this Agreement.

1. Nature of the Services

Flashteks provides business management software for merchants, including tools for:

Appointment booking
Customer management
Order and ticket management
Reporting and business analytics
Point-of-sale workflow
Online payments (booking deposits, gift cards, memberships) through Stripe or partner merchant service providers

Flashteks is a software provider only and is not the merchant of record for transactions processed by merchants using the Services.

2. Payment Processing

Payments made through the Services are processed by Stripe, Inc. (“Stripe”) or by partner merchant service providers that Flashteks integrates with (together, “Payment Processors”). Flashteks does not process, store, or transmit full credit card numbers or security codes; card details are entered on pages or devices provided by the Payment Processor and are encrypted and managed by it. Use of a Payment Processor is subject to its own terms, including the Stripe Services Agreement for Stripe.

Payments that a merchant’s customers make online (booking deposits, gift cards, memberships and similar) are processed through the merchant’s own account with the Payment Processor. The merchant is the merchant of record for those transactions. Card-present payments taken at the merchant’s point of sale are processed by the merchant’s own payment terminal provider or a partner merchant service provider.

Merchants remain solely responsible for:

The goods and services they sell
Customer transactions
Taxes and legal compliance
Refunds, disputes, and chargebacks with their customers

2A. Fees, Plan Renewals and Card on File

Subscription fees, plan renewals and Marketplace add-ons (such as SMS or email packages and optional modules) that a merchant purchases from Flashteks are billed by Flashteks through Stripe, in Canadian dollars plus applicable tax, at the prices shown in the merchant’s account at the time of purchase.

One-time purchases (add-on packages, 6-month and annual plan renewals) are charged once, when the merchant confirms the purchase.
Subscriptions (monthly plan renewal and optional modules) renew automatically at the stated interval until cancelled. By starting a subscription the merchant authorizes Flashteks to charge the payment method used for each renewal.
Card on file. A merchant may save a payment card in Store Settings. By saving a card the merchant agrees to these Terms and authorizes Flashteks to charge that card for purchases the merchant confirms from their account and for subscriptions the merchant has chosen. Flashteks never charges a card on file for a one-time purchase without the merchant’s confirmation. The card can be removed at any time; removing it does not cancel existing subscriptions, which will then request payment when due.
Failed payments. If a subscription charge fails, Flashteks will notify the account owner by email and retry the payment. A subscription that remains unpaid may be cancelled and the related module switched off; a Flashteks plan that remains unpaid after its expiry date and grace period may result in the merchant’s account being suspended until payment is made.
Plan changes. Switching from a monthly plan to a 6-month or annual plan cancels the monthly subscription once the new term is paid. Prepaid periods are not shortened by a later change.

Fees paid to Flashteks are non-refundable except where required by law or agreed in writing by Flashteks. Questions about a charge should be sent to the contact address in Section 12 within 30 days of the charge.

3. Eligibility

You must be of legal age and authorized to enter agreements on behalf of your business to use the Services.

4. Account Responsibilities

You are responsible for:

Maintaining confidentiality of login credentials
All activity under your account
Ensuring your staff use the Services lawfully

5. Acceptable Use

You agree not to:

Use the Services for illegal activities
Attempt to access unauthorized systems
Reverse engineer or copy the software
Interfere with system security or operations

6. Service Availability

Flashteks strives to maintain reliable Services but does not guarantee uninterrupted availability. Maintenance, outages, or third-party issues (including Payment Processors, SMS/email carriers or internet providers) may affect operation.

7. Data Ownership

Merchants retain ownership of their business and customer data. Flashteks may process data solely to provide Services as described in the Privacy Policy.

8. Intellectual Property

All software, designs, and content are the property of Flashteks or its licensors.

9. Limitation of Liability

Flashteks is not liable for:

Merchant business losses
Payment disputes
Chargebacks
Data entered incorrectly by users

Use of the Services is at your own risk.

10. Termination

Flashteks may suspend or terminate accounts that violate this Agreement.

11. Governing Law

This Agreement is governed by the laws of Alberta, Canada.
